These Terms of Service (“Terms”) form a legally binding agreement between you (“you”, “User”) and Executive CV Builder (“we”, “us”, “our”, “Company”) regarding your access to and use of our website, tools, templates, services, and any related features (collectively, the “Services”).

If you do not agree to these Terms, do not use the Services.

2. Eligibility and Account Responsibility

Age requirement: You must be at least 18 years old to create an account or make purchases.

Account accuracy: You agree to provide accurate and up-to-date information and to keep your login details confidential.

Account activity: You are responsible for all activity under your account. Notify us immediately if you suspect unauthorised use.

3. What We Provide

Executive CV Builder provides tools to create, edit, format, and download CVs, resumes, cover letters, and related career documents. Features may include templates, design formatting, document previews, export tools, and optional premium services.

We may add, remove, or change features from time to time.

4. User Content and Your Data

4.1 Your Content

“User Content” includes any information you upload or enter, such as your name, email, phone number, education, work history, and CV text.

You confirm that you have the rights to submit your User Content and that it does not violate any third-party rights.

4.2 Limited Licence to Operate the Service

You grant us a limited licence to host, process, and display your User Content only to provide and improve the Services, including generating your documents and enabling downloads. This licence ends when you delete your content or account, except where we must retain certain records for legal, security, or dispute purposes.

4.3 No Confidentiality Guarantee for Public Areas

If we offer public reviews, community posts, or shared templates, anything you post there may be visible to others. Do not post sensitive information in public areas.

5. Acceptable Use

You agree not to misuse the Services. You must not:

Use the Services for unlawful purposes or to violate any Kenyan or applicable laws.
Upload malicious code, viruses, or attempt to disrupt the Platform.
Attempt to access other users’ accounts or data.
Scrape, crawl, reverse engineer, or copy the Services or templates at scale without permission.
Use automated tools (bots) to create accounts, generate downloads, or abuse free trials.
Impersonate any person or organisation or submit false credentials or claims.
Use the Services to create documents that facilitate fraud, identity theft, or misrepresentation.

We may suspend or terminate access where we reasonably believe there is misuse, fraud, security risk, or breach of these Terms.

6. Fees, Subscriptions, and Payments

6.1 Pricing

Some features may be free, while others require payment. Prices are shown on the Platform before you pay and may change from time to time.

6.2 Payment Methods

We may accept M-Pesa, debit or credit cards, and other third-party payment options depending on availability.

6.3 Billing and Authorisation

By providing a payment method, you authorise us (and our payment processors) to charge the applicable fees, including taxes where required.

6.4 Subscriptions

If you purchase a subscription:

Your subscription renews automatically unless you cancel before the renewal date.
You can cancel through your account settings or by contacting support.
Cancellation takes effect at the end of the current billing period, unless stated otherwise at checkout.

7. Refund Policy

Because our Services involve immediate access to digital tools and downloadable content, refunds are generally limited.

Unless required by Kenyan law or explicitly stated at checkout:

Subscription fees are non-refundable once charged for a billing period.
If you experience a technical issue that prevents access to paid features, contact support promptly. We may offer a remedy such as troubleshooting, service credit, extension time, or a refund where appropriate and reasonable.
If you made a payment error (wrong plan, duplicate charge), contact support with proof of payment and details within a reasonable time.

8. Intellectual Property

The Platform, templates, designs, branding, logos, text, and software are owned by us or licensed to us and are protected by intellectual property laws.

You receive a limited, personal, non-transferable licence to use the Services for your own document creation.

You may not reproduce, sell, sublicence, distribute, or commercially exploit our templates or platform assets unless we give written permission.

Your CV content remains yours, subject to the limited licence in Section 4.

9. Third-Party Services and Links

The Platform may integrate with or link to third-party websites or services (for example, payment processors). We do not control third-party services and are not responsible for their content, policies, or performance. Your use of third-party services is subject to their terms.

10. Privacy

We handle personal data in line with our Privacy Policy, which explains what we collect, how we use it, and your rights. The Privacy Policy is incorporated into these Terms by reference.

If you use the Services, you agree to the collection and processing described in the Privacy Policy.

11. Service Availability and Changes

We aim to keep the Platform available, but we do not guarantee uninterrupted access. There may be downtime due to maintenance, upgrades, or factors beyond our control (including internet outages or third-party service issues).

We may modify, suspend, or discontinue parts of the Services at any time. Where you have an active paid subscription, we will act reasonably and in good faith when making material changes.

12. Disclaimers

The Services are provided on an “as is” and “as available” basis.

We do not guarantee that your use of the Services will lead to interviews, job offers, promotions, or any specific outcome.

You are responsible for ensuring that the information in your CV is accurate and appropriate for your situation and industry.

13. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, business opportunities, or data.
Our total liability arising out of or related to the Services will not exceed the amount you paid to us in the three (3) months before the event giving rise to the claim.

Nothing in these Terms limits liability where it cannot be limited under applicable law.

14. Indemnity

You agree to indemnify and hold us harmless from claims, losses, liabilities, and expenses arising out of:

your breach of these Terms,
your misuse of the Services, or
your User Content infringing third-party rights.

15. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, if we detect suspected fraud or misuse, or if required by law.

On termination, your right to use the Services ends immediately. Certain sections that should reasonably continue will survive termination, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnity, and Dispute Resolution.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of Kenya.

If a dispute arises, the parties will first try to resolve it informally by contacting support. If unresolved, the dispute will be submitted to the courts of Kenya, which will have exclusive jurisdiction, unless applicable law requires otherwise.

17. Changes to These Terms

We may update these Terms from time to time. When we update them, we will revise the “Last Updated” date above. Continued use of the Services after changes take effect means you accept the updated Terms.

18. Miscellaneous

If any part of these Terms is found unenforceable, the remaining parts remain in effect.

These Terms, together with the Privacy Policy and any checkout terms shown to you, form the entire agreement between you and us regarding the Services.

You may not transfer your rights under these Terms without our written consent. We may transfer our rights as part of a business restructure, sale, or merger.
